Hunter Capital Markets Arranges Refinancing Package for The DoubleTree by Hilton Hotel Chicago – North Shore Conference Center

 SKOKIE, IL, April 24, 2013—Hunter Capital Markets, a division of Hunter Hotel Advisors, announced today that it secured a refinancing of the 369-room DoubleTree by Hilton Hotel Chicago – North Shore Conference Center in Skokie, Ill., on behalf of Ultima Hospitality, a Chicago-based hospitality management and real estate investment group.

First Green Bank Reports Assets Valued at $225 million in March; offering tops $5 million

MOUNT DORA, FL  --- First Green Bank, based in Lake County, reported its bank assets total more than $225 million as of March 31, 2013.

Kenneth LaRoe, chairman of First Green Bank, said First Green Bancorp’s first stock offering has raised more than $5 million so far and he expects to reach the $10 million mark before the offering closes June 30.

First Green Bank marked the official opening of its downtown Orlando branch with a cocktail reception on Thursday, April 11. The bank, which opened in February 17, 2009, now has branch facilities in Clermont, Ormond Beach, and downtown Orlando.

Stan Johnson Co. Completes Sale of Two Garden Ridge Properties in Oklahoma for $19.6 million.

TULSA, OK(April 22, 2013) – Stan Johnson Company, one of the nation’s premier net lease brokerage firms, has completed the sale of two Garden Ridge retail stores for a total of $19.6 million. The properties are located at 11015 E. 51st Street South in Tulsa, OK, and 701 S. Macarthur in Oklahoma City, OK.

Steady Progress: Industrial Real Estate Continues to Grow Healthier

 ATLANTA, GA (April 22, 2013) – Buoyed by improvements in the overall economy and the housing market, the U.S. industrial real estate sector continued to strengthen in first-quarter 2013 and is set for a promising future.

 That was the consensus of a panel of experts on the most recent episode of the “Commercial Real Estate Show” radio program, hosted by Michael Bull of Bull Realty. The episode provided an enlightening look at industrial real estate’s performance in the first quarter. Topics included vacancy rates, investment sales, active tenants and cap rates.

Net absorption of industrial real estate in the 54 largest U.S. markets totaled 25 million square feet in the first quarter, said Rene Circ, director of research for PPR, a CoStar-owned firm. That figure, while a good bit below the 40 million square feet of absorption typical of a pre-recession quarter, is still about three times larger than first-quarter 2012’s total, according to Circ.

At the same time that demand is growing, new supply continues to remain “exceptionally low,” Circ said. About 13 million square feet of new industrial facilities were delivered in the United States during the first quarter, and roughly 38 million square feet of facilities were under construction at the end of March. Both figures are well below historical averages, Circ noted.

 Consequently, the national vacancy rate for the industrial sector dipped to 8.2 percent in the first quarter, a 20-basis-point decline from the preceding quarter and a 100-basis-point drop from one year earlier, Circ noted. The average rent increased by 2.5 percent on a year-over-year basis during the quarter.

Overall, “we had a really good quarter during the first three months of the year,” Circ said. The national vacancy rate could drop to about 7.7 percent by year’s end, he added.

 Much of the tenant activity in the past two years has centered around e-commerce firms moving into large distribution facilities, said Jim Brice, a partner with Holt Lunsford Commercial, a Dallas-based commercial real estate firm. However, smaller tenants – those occupying 300,000 square feet or less – have started to return to the sector as suppliers respond to an improving housing market, he added.

 “Everything that goes into a house has to be in a warehouse,” Brice said. “So as home-building increases, there’s no question [warehousing is] going to increase as well.”

 The industrial sector has improved to the point that some spec construction is taking place around the country, and REITs are responsible for more than 90 percent of that activity, according to Rob Riner, a partner in the Dallas office of Panattoni Development. “It’s easy for REITs since they don’t have to go do a normal bank loan that other equity sources will sometimes have to do,” Riner said.

Cortland Acquires 2,237 Apartment Homes in Atlanta, GA and Dallas, TX for $244 Million

ATLANTA, GA (April 22, 2013) — Cortland Partners continued its expansion in the multifamily sector by acquiring five communities totaling 2,237 apartment homes in a series of transactions with a total capital investment of $244 million. Four of the communities are located in the Atlanta MSA and the fifth is in the Dallas MSA.

The Atlanta-based multifamily investment firm funded the acquisitions in part through equity provided by its new alliance with two institutional capital partners. Debt capital for the transactions was provided by Freddie Mac through Walker Dunlop ($75.85 million) and through a loan commitment led by Ares Commercial Real Estate Corporation ($107.1 million).

 “We continue the execution of our strategic investment plan as we hit our stride with these acquisitions and new institutional capital sources. 3 Condo Towers With 600 Units Proposed For Greater Downtown Miami Area

Feeling Less Distress: CRE Lawyers Say Their Work Is Shifting Away from Troubled Assets

 ATLANTA, GA– Commercial real estate lawyers are doing less work with distressed assets and are instead spending more hours on leases and investment sales.

 That was one of the points made by a panel of attorneys on the most recent episode of the “Commercial Real Estate Show” radio program, hosted by Michael Bull of Bull Realty.

The episode provided an enlightening look at the various legal issues confronting the commercial real estate sector. Topics included loan workouts, selling and buying notes, foreclosures and the most pressing lease issues.

  “The last few years have definitely been a turn for the better,” said Andrew Litvak, a partner with the Nelson Mullins law firm. “We’re seeing more of what I would characterize as good work: leasing activity, investment sales and purchases. There’s still a lot of pent-up distressed real estate and problems to be worked out, but it seems to be tapering off.”

When faced with troubled assets, many lenders are choosing to sell notes instead of foreclosing on the underlying properties, as foreclosure can be an expensive process that exposes them to the risks and hassles of property ownership. 

Someone thinking of buying such a note should be prepared to perform rigorous due diligence, especially when, as is often the case, the loan was between a bank and a borrower who have enjoyed a long and friendly relationship, said Jeffrey Schneider, a partner with the Weissman Nowack Curry & Wilco law firm.

 “You’ve got to really drill down on the loan-servicing side,” Schneider said. “Make sure there aren’t any handshake agreements to waive penalties or payments. Get as much loan-servicing information as you can get.”

 Due diligence can become especially complicated and time-consuming when buying a large portfolio of loans, because the underlying assets typically are scattered across several states, said Michael Ward, who is of counsel at the Greenberg Traurig law firm. “From a legal side, the sheer due diligence … can be fairly intensive,” Ward said.

 Such large loan portfolios usually are aggressively pursued by several bidders, Ward added. “You’re going to have two, three or four large players going after that one portfolio, and they’re very competitive,” he said.

 Lenders generally are more willing to make loans these days but they also have beefed up their loan covenants, said Carter Stout, real estate practice leader at the Stout Atwood LLC law firm. By and large, borrowers don’t have much negotiating power to make those covenants less severe, Stout added.

 “The practical reality is, generally, there are very few sources of money out there, and [borrowers] are stuck with a small group of lenders who are going to insist on certain covenants,” Stout said.

Annaly and CreXus Announce Final Results of Annaly Tender Offer

(NYSE:CXS) (“CreXus”) announced the final results of the tender offer (the “Offer”), which commenced on March 18, 2013 and expired at 5:00 PM ET on April 16, 2013, whereby through a newly formed subsidiary, CXS Acquisition Corporation (“Acquisition”), Annaly offered to purchase all the shares of CreXus that Annaly does not already own.

Annaly has accepted for purchase 55,225,336 shares of CreXus’ common stock at a purchase price of $13.05206 per share, for an aggregate cost of approximately $720.8 million, excluding fees and expenses relating to the Offer.

The final Offer price of $13.05206 per share consists of a price per share of $13.00 plus a payment in lieu of a prorated CreXus dividend of $0.05206 for the period from March 29, 2013 through April 16, 2013 (the date the Offer expired). 

The payment in lieu of a prorated dividend is based on the dividend of $0.25 per share that CreXus paid to holders of record on March 28, 2013, the calendar quarter immediately before the date the Offer expired.
